OUR TRADE TERMS

  1. Confirmations received by PHD Fencing (including by email or SMS) from the Clients for the supply of Goods/Services shall constitute acceptance of the terms and conditions contained herein

  2. PHD Fencing shall only be responsible for their performance to the Clients who contracts them to undertake the Services and shall not be responsible to any third party irrespective of their relationship to the Clients

  3. In the event that PHD Fencing is denied access to the worksite on the agreed start date or PHD Fencing has to cancel/ delay works because of Clients did not obtain their responsibilities or Client changes their requirements, then PHD Fencing reserves the right to charge the Clients for all costs incurred by PHD Fencing (including, but not limited to, any loss of profits, employee wages, minimum charge is ten percent (10%) of the contract Price).

  4. The height of the fence which is nominated in the quote shall be the maximum height provided, the heights may vary depending on construction and land level.

  5. All quotes are based on standard fences constructed to existing land levels and/or slopes. Special requests need to be addressed at the time of quotation

  6. In the event of gaps that are common under new fences, this being a landscaping issue, should this occur they can be covered or filled at an extra cost on request

  7. The Clients must be on site to supervise the setting out of the fence construction string line. The Clients will ensure the placement of boundary markers prior to fence construction. If the Clients fail to comply with this clause then PHD Fencing accepts no responsibility for installation decisions that need to be made in the Clients absence.

  8. The Clients have responsibility to remove any existing fence (including existing footings), trees, vines and shrubs to allow the PHD Fencing clear access along the proposed fence line prior to commencement of work unless otherwise agreed in writing

  9. Where fencing is installed on a retaining wall, PHD Fencing shall not be liable for any movement in the fence due to consolidation or the movement of soil or any other component of the retaining wall.

  10. PHD Fencing shall not be responsible for digging land out under fence lines nor removal of soil from the work site.

  11. All care but no responsibility for damage to underground cables, pipes & garden

  12. PHD Fencing is not responsible for the removal of rubbish (including but not limited to excess soil, old bricks, old concrete) from or clean up of the worksite and/or restoring of garden beds. This is the responsibility of the Clients or the Clients agent.

  13. The Clients shall remove from the work area any furniture, personal effects or other property (including but not limited to watering systems, pot plants, garden plants, ornaments, gates, pergolas, pool equipment etc

  14. The Clients shall provide PHD Fencing with clear and free access to the worksite to complete the Services

  15.  PHD Fencing shall not be liable for any loss or damage to the site (including, without limitation, damage to pathways, driveways and concreted or paved or grassed areas) during the normal construction process; and

  16. The Clients provide power and water for installation of the Goods, if the Clients cannot accommodate this condition the Clients agree to indemnify PHD Fencing for all additional costs incurred (including but not limited to the hire of a generator, cart water etc).

  17. The Clients have to deposit 50% of total amount or agreed amount for booking, the balance payment shall be due on delivery/completion of the Goods/Services unless prior approval.

  18. In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs

  19. Overdue accounts will be subject to interest at the rate of 13% p.a., calculated for the period the account is due until the date it is paid.

  20. PHD Fencing and the Clients agree that ownership of the Goods shall not pass untill the Clients have paid all amounts owing for the particular Goods/ the end Products; and

  21. Before passing of owing the Goods/ the end Products, PHD Fencing has the right to ask Clients return the Goods/ the end Products to PHD Fencing. If the Clients fail to return the Goods/ the end Products to PHD Fencing,  then PHD Fencing or PHD Fencing’s agent may enter upon and into land and premises owned, occupied or used by the Clients, or any premises as the invitee of the Clients, where the Goods are situated and take possession of the Goods.

1 Year Warranty on Installation

​

PHD Fencing warrants for any defect apparent and is reported to PHD Fencing  within twelve (12) months of the date of the fence installation. In such case, PHD Fencing will repair or replace at no additional charge. The warranty shall not cover any defect or damage which may have been caused or partly caused by Clients or someone else who is not PHD Fencing’s employees.

10 Year Warranty on Colorbond Products

​

The Colorbond materials shall be warranted for 10 years by the manufacturers. The terms and conditions are subject to the current version of the manufacturer's warranty as of the date of the fence installation.
